What Georgia law says
Georgia recognizes both special damages (medical expenses, lost income) and general damages such as pain and suffering under O.C.G.A. § 51-12-2 et seq., with the measure of pain and suffering left to the enlightened conscience of the jury.
How this actually works
Georgia allows recovery of special damages — medical bills, lost wages, future care and diminished earning capacity — plus general damages for pain, suffering and loss of enjoyment of life. There is no statutory formula and no cap in ordinary negligence cases.
The practical ceiling in most cases is not the injury, it is the available coverage. When the at-fault driver carries the state minimum of $25,000, the claim is worth what can be collected from that policy plus your own UM coverage, plus any commercial or employer policy if the driver was working.
Value also moves on evidence quality: consistent treatment without long gaps, objective imaging, a clear liability picture, and credible testimony about how the injury changed daily life. In MCA's experience, gaps in treatment are among the most common reasons offers come in low.
